Terms and Conditions
Terms and Conditions
Last updated (effective date): Pending Jacob's confirmation of the launch date.
1. About these Terms
These Terms and Conditions (the "Terms") apply to purchases made from Shack In The Back Designs through the sales channels listed in Section 1.2 (Channel scope).
1.1 Seller details
In these Terms:
- "Shack In The Back Designs," "we," "us," and "our" mean Shack In The Back Designs, a general partnership, of 164 Andrew St, Newcastle, Ontario, Canada (postal code to be added);
- Website: shackintheback.ca;
- Email: shackinthebackdesigns@gmail.com;
- "customer," "you," and "your" mean the person purchasing or attempting to purchase Products from us; and
- "Products" means the physical products we offer through the applicable sales channel.
1.2 Channel scope (Square, Etsy, CraftedCanadian)
These Terms apply to purchases made through:
- our website at shackintheback.ca, which is a catalogue and order-request site where you browse our catalogue, submit an order request, and pay a Square invoice;
- our Etsy shop; and
- the CraftedCanadian marketplace.
Important: Etsy and CraftedCanadian each have their own terms, policies, tools, and dispute processes that also apply to purchases made on those platforms. If there is a conflict between these Terms and the applicable Etsy or CraftedCanadian policies for a platform purchase, the platform's terms/policies prevail to the extent of the conflict for that platform purchase.
By using a sales channel, submitting an order request, paying a Square invoice, or otherwise purchasing a Product, you agree to these Terms and any applicable platform terms. If you do not agree, do not place an order.
You may also be required to agree to the terms of third-party service providers such as Square, Etsy, CraftedCanadian, Canada Post, payment processors, and other providers. Those terms may apply to the services provided by those third parties.
2. Our Products
We offer handmade and technology-crafted Products, including:
- 3D-printed creatures and articulated figures made from PLA, including Cinderwing3D dragons, Zou3D miniatures, fidgets, and similar items;
- handmade crochet critters, including animals and sea creatures; and
- laser-engraved campsite signs, cutting boards, wind spinners, tumblers, and personalized mini sports jerseys.
Product descriptions, photographs, dimensions, colours, materials, and other details are provided in good faith. We aim to describe and photograph Products accurately, but:
- handmade and 3D-printed Products may contain natural, minor, or expected variations;
- colour, texture, finish, markings, and other details may differ from photographs because of materials, lighting, screens, printers, finishing methods, and the handmade nature of the Product;
- small imperfections may occur and may be part of the character of a handmade or 3D-printed Product;
- dimensions are approximate unless a listing states otherwise; and
- Products may differ slightly from one another even when made from the same design.
Unless expressly stated otherwise in a Product listing, photographs are examples and do not guarantee an identical result.
We may correct errors, update Product information, discontinue Products, or limit quantities at any time. A correction or update will not affect an order that we have already accepted, except where required by law or where the error concerns a material price, description, or availability issue that could not reasonably have been identified.
3. Pricing, currency, and taxes
All prices are stated in Canadian dollars (CAD) unless our listing or invoice clearly states otherwise.
Applicable sales taxes, shipping charges, and any other disclosed charges are calculated and shown on your invoice before you pay it, based on the shipping destination and applicable law.
Prices may change at any time. The price charged for an accepted order is the price shown on your invoice, subject to correction of an obvious pricing or listing error and any rights available under applicable consumer protection law.
4. Orders and acceptance
To submit an order request through our website, you must provide complete and accurate information, including your name, contact information, shipping address, and any details needed for the Product (for example size, colour, finish, personalization, or customization).
Before submitting an order request, you are responsible for reviewing:
- the Products and quantities requested;
- any size, colour, finish, personalization, or customization details;
- the shipping address; and
- any other information you submit in the order request.
Submitting an order request is a request to purchase the selected Products under these Terms. After you submit an order request, we may reply by email with a Square invoice. An invoice confirms that we received your request; it does not necessarily mean that we have accepted it.
An order is accepted when we confirm acceptance by email, when we send a dispatch confirmation, or when we begin fulfilling the order, whichever occurs first. Payment through Square completes the order. We may decline, limit, or cancel an order before acceptance, including where:
- a Product is unavailable;
- there is an error in the Product description or price;
- the order appears fraudulent or unauthorized;
- the shipping destination is unavailable;
- the requested customization cannot reasonably be completed;
- we believe the order is intended for resale or unlawful use; or
- a technical or payment-processing problem prevents completion.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order using the original payment method, subject to applicable law.
5. Payment
Payment is made through the Square invoice we send you, using the payment methods Square makes available.
Payment must be authorized before an order is accepted or shipped. We may use third-party payment processors, including Square, and do not receive or store complete payment-card numbers through our own systems.
If a payment is declined, reversed, disputed, or otherwise not completed, we may cancel or suspend the order until payment is successfully received.
You agree not to use a payment method that you are not authorized to use and not to initiate a fraudulent or improper chargeback. This does not limit any right you may have to dispute a legitimate transaction.
6. Shipping and delivery
We ship physical Products across Canada via Canada Post.
Shipping charges and available shipping methods (including any flat-rate options) are shown on your invoice. Orders may be shipped in separate packages where Products have different processing times or are otherwise not ready at the same time.
Free standard shipping is available on orders over $60 within Canada.
Items that are larger than our standard product sizes (for example, an oversized dragon) do not qualify for free shipping regardless of order value. Standard-size camp signs and cutting boards do qualify. For custom and made-to-order pieces larger than our standard product sizes, the exact shipping cost is confirmed with the invoice rather than being a fixed published rate.
6.1 Processing/handling times
Estimated processing/handling times are:
- ready-made physical Products: (to be confirmed);
- made-to-order physical Products: (to be confirmed); and
- custom or personalized physical Products: (to be confirmed).
6.2 Delivery estimates (after dispatch)
Estimated delivery times after dispatch are:
- within Canada: (to be confirmed by region).
Processing and delivery times are estimates, not guarantees, unless we expressly agree in writing to a guaranteed delivery date. Delays may result from weather, transportation interruptions, customs processing, incorrect addresses, labour disruptions, high-volume periods, or circumstances beyond our reasonable control.
6.3 Standard Flat Rate shipping (definition)
Some sections of these Terms refer to our "Standard Flat Rate" shipping service. (The amount and coverage of the Standard Flat Rate service are to be confirmed.)
6.4 Addresses, delivery confirmation, and problems
You are responsible for providing an accurate and complete shipping address. If an order is delayed, returned, or delivered incorrectly because the address provided was incomplete or inaccurate, additional shipping charges may apply before re-shipment.
A package may be considered delivered when Canada Post (or the applicable carrier) records it as delivered to the shipping address or delivery location provided with the order. If tracking indicates delivery but you cannot locate the package, you should first check with household members, building management, neighbors, and the carrier. Contact us at shackinthebackdesigns@gmail.com if the issue is not resolved.
You should inspect physical Products promptly after delivery and notify us of damage, defects, or an incorrect Product promptly after delivery.
Nothing in these Terms limits a consumer's rights where applicable law provides a remedy for non-delivery, late delivery, defective goods, or goods that do not conform to the agreement.
7. Returns, exchanges, and refunds for physical Products
This section folds in our live Return and Exchange Policy for physical Products.
7.1 Returns/exchanges — 30-day window and eligibility
You have 30 calendar days from the date your order was received to request a return or exchange for eligible physical Products.
To be eligible, the item must be:
- unused and unwashed;
- in the same condition you received it;
- in its original packaging, with all tags attached; and
- accompanied by valid proof of purchase (order number or receipt).
7.2 Return Authorization (RA) process — required
To request a return or exchange, email shackinthebackdesigns@gmail.com and include:
- your order number (or receipt);
- the reason for the return or exchange; and
- photos where relevant (for example, damage).
We will reply within 1–2 business days with:
- a Return Authorization (RA) number; and
- the exact return shipping address you must use.
Returns without a valid RA number may be delayed or refused. Write the RA number on the outside of the box and ship the return to the address we provide.
7.3 Return shipping costs
- Change of mind / size / colour: you are responsible for return shipping costs. We recommend using a trackable shipping service such as Canada Post or UPS. We are not responsible for packages lost in transit on customer-paid returns.
- Defective / damaged / wrong product: we will cover return shipping and provide a prepaid return label.
7.4 Non-returnable / final sale items
The following items are non-returnable and final sale:
- custom and personalized items (any product made, customized, or modified specifically for your order); and
- sale/clearance items marked "Sale," "Clearance," or "Final Sale" at the time of purchase.
7.5 Refunds, exchanges, and store credit (after inspection)
After we receive your return, we will inspect it (usually within 1–3 business days after arrival). If approved, we will provide one of the following outcomes, as applicable:
- Full refund: the full merchandise cost will be credited to your original payment method. Original shipping fees are non-refundable. Please allow 3–5 business days for the credit to appear.
- Exchange: we will ship your requested replacement (if available). Exchange shipments are sent using our "Standard Flat Rate" shipping service at no charge. If the requested replacement is unavailable, we will issue a refund.
- Store credit: we will issue a digital gift card or credit code for the full merchandise value and send it by email.
7.6 Relationship to platform policies (Etsy/CraftedCanadian)
If you purchased through Etsy or CraftedCanadian, the platform's return/refund rules and processes may also apply, and may affect how returns, refunds, labels, and timelines are handled. Where a platform policy conflicts with this Section 7 for a platform purchase, the platform policy prevails to the extent of the conflict.
8. Custom and made-to-order Products
Custom and made-to-order Products are produced according to the details agreed with you. Before production begins, we may request confirmation of specifications, artwork, measurements, colours, text, or a digital proof.
Estimated lead times for custom and made-to-order Products are (to be confirmed). The lead time may begin only after:
- payment has been received;
- all required information and artwork have been supplied;
- any proof has been approved; and
- any other required customer confirmation has been received.
You are responsible for responding promptly to requests for information or approval. Delays caused by missing information, late approvals, inaccurate specifications, or changes requested by you may extend the lead time.
You may request cancellation before production begins by contacting us at shackinthebackdesigns@gmail.com. Once production has started, the order cannot be cancelled and the Product is non-returnable and non-refundable, except where required by applicable law or where the Product is defective, damaged, or materially different from the agreed specifications.
9. Product care and safety
You must use each Product only for its intended purpose and follow any care instructions supplied with the Product or stated in its listing.
9.1 3D-printed PLA Products
PLA is a thermoplastic material. Unless a listing expressly states otherwise:
- do not expose PLA Products to high heat, open flame, hot vehicles, ovens, dishwashers, or other heat sources;
- do not use PLA Products as cookware, food-storage containers, medical devices, protective equipment, or load-bearing safety equipment;
- do not use a Product in a way that could cause it to melt, deform, break, or create a hazard; and
- inspect Products periodically for damage, loose parts, cracks, or sharp edges.
A Product made with PLA should not be assumed to be heat-resistant, food-safe, dishwasher-safe, or suitable for outdoor use unless the listing expressly says so.
9.2 Small parts and choking hazards
Many Products contain small parts, detachable parts, flexible parts, magnets, accessories, or components that may create a choking or other safety hazard.
Unless a listing states a different age recommendation:
- Products containing small parts are intended for ages 6+;
- Products marked "3+ with adult supervision" must be used only with active adult supervision; and
- adult supervision is recommended for children using any Product, particularly articulated figures, fidgets, craft kits, accessories, and Products with detachable parts.
Keep Products away from babies and children who may place objects in their mouths. Do not allow a child to use a Product that is broken, damaged, or missing a component.
Product age guidance is a safety recommendation and does not replace the judgment of a parent, guardian, or supervising adult.
9.3 Crochet, laser-engraved, and other Products
Crochet Products may contain yarn ends, stuffing, eyes, attachments, or other components that may present a risk if pulled, chewed, or detached.
Laser-engraved Products, cutting boards, tumblers, and other Products may have specific care requirements. Follow the instructions provided with the Product. Do not assume that an engraved item is food-safe, dishwasher-safe, microwave-safe, or suitable for a particular use unless the listing expressly confirms it.
If you are unsure whether a Product is suitable for a particular person, age group, or use, contact us before ordering.
10. Age restrictions and children's Products
You must be at least 18 years old to place an order, or have the permission and supervision of a parent or legal guardian.
A parent or legal guardian is responsible for:
- reviewing Product descriptions and age recommendations;
- deciding whether a Product is appropriate for a child;
- supervising a child's use of the Product where required or recommended; and
- ensuring that Products are stored and used safely.
We do not knowingly collect personal information directly from children where parental consent is required by applicable law. A parent or guardian who believes that a child has provided personal information to us may contact us at shackinthebackdesigns@gmail.com.
11. Intellectual property
All rights in the Shack In The Back Designs brand, website content, original product designs, photographs, graphics, descriptions, logos, text, and other materials created by or for us are owned by Shack In The Back Designs or used under permission. They may not be copied, reproduced, modified, distributed, sold, or commercially exploited without our prior written permission.
Some physical Products incorporate models, patterns, artwork, or designs licensed from third-party designers. This may include models associated with Cinderwing3D, Zou3D, or other designers. We use those third-party designs only as permitted by the applicable licence or permission. We do not claim ownership of intellectual property belonging to those third-party designers.
Purchasing a physical Product does not give you ownership of the underlying design, model, pattern, artwork, file, or other intellectual property. It gives you ownership of the physical item purchased, subject to these Terms and any applicable law.
11.1 Customer-supplied artwork and content
If you provide artwork, photographs, logos, text, names, graphics, or other materials for a custom order ("Customer Content"):
- you retain ownership of the Customer Content that you own;
- you grant us a limited, non-exclusive, royalty-free licence to use, reproduce, adapt, format, and process the Customer Content only as reasonably necessary to quote, design, produce, quality-check, fulfil, and support your order;
- you confirm that you have all rights, permissions, and consents needed for us to use the Customer Content for those purposes; and
- you agree that your Customer Content will not infringe another person's intellectual property, privacy, publicity, or other rights and will not contain unlawful, threatening, hateful, or abusive material.
Unless we agree otherwise in writing, we do not verify that customer-supplied artwork is legally cleared for use. We may refuse Customer Content that we reasonably believe may infringe rights, be unlawful, or create a safety, reputational, or operational concern.
We will not use Customer Content in marketing, social media, portfolios, or public displays without your separate written permission.
12. Reviews, photographs, and other user-submitted content
If you submit a review, photograph, video, comment, testimonial, or other content relating to our Products ("User Content"), you grant Shack In The Back Designs a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, publish, display, adapt, and share that User Content for business, promotional, educational, and social media purposes.
You confirm that:
- you created the User Content or have permission to submit it;
- the User Content does not infringe another person's rights;
- you have obtained consent from any identifiable person shown in the User Content where required; and
- the User Content is accurate to the best of your knowledge and is not unlawful, misleading, defamatory, abusive, or harmful.
We may moderate, refuse, edit for length or formatting, or remove User Content, but we are not required to monitor every submission.
13. Third-party platforms and links
Our website may use or link to third-party services, including Square, Etsy, CraftedCanadian, Canada Post, payment processors, social media platforms, analytics providers, and other websites.
Third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, security, content, policies, or performance of third-party services, except to the extent liability cannot lawfully be excluded.
13.1 CraftedCanadian marketplace constraints
If you purchase through CraftedCanadian, you must complete the transaction within that platform, and we must comply with CraftedCanadian's marketplace rules.
- CraftedCanadian prohibits sellers from redirecting customers off-platform (for example: by providing links, QR codes, or directions to a personal website, another marketplace listing, or an off-platform checkout option) within marketplace transactions and messages.
- CraftedCanadian charges an administration fee to vendors of 10% (retail) and 5% (wholesale) on the product total (before taxes and shipping), subject to CraftedCanadian's current rules.
14. Limitation of liability
To the maximum extent permitted by applicable law, Shack In The Back Designs will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive losses, including loss of profits, revenue, business opportunity, data, goodwill, or expected savings, arising from or relating to:
- the use or inability to use our website;
- a delay or interruption in a third-party service;
- a delivery delay outside our reasonable control;
- misuse, alteration, or unsafe use of a Product;
- failure to follow Product care or safety instructions; or
- the use of a Product for a purpose for which it was not designed.
To the maximum extent permitted by applicable law, our total liability relating to a Product or order will not exceed the amount paid for the specific Product or order giving rise to the claim.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence where such limitation is prohibited;
- fraud or fraudulent misrepresentation;
- wilful misconduct;
- a statutory warranty, guarantee, cancellation right, or consumer protection remedy that cannot legally be excluded or limited; or
- any other liability that cannot legally be excluded or limited.
15. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Shack In The Back Designs, its owners, workers, contractors, and service providers from claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from or relating to:
- your breach of these Terms;
- your misuse of a Product;
- your failure to follow Product care or safety instructions;
- Customer Content or User Content supplied by you;
- your violation of another person's intellectual property, privacy, publicity, or other rights; or
- your violation of applicable law.
This indemnity does not apply to the extent that a claim was caused by our negligence, wilful misconduct, or breach of a non-excludable legal obligation.
16. Events beyond our reasonable control
We are not responsible for delay or failure to perform caused by circumstances beyond our reasonable control, including severe weather, fire, flood, power failure, equipment failure, internet or platform outages, supply shortages, transportation disruption, customs delays, labour disruption, government action, public health emergencies, or other similar events.
If an event materially affects an order, we will take reasonable steps to notify you and may offer an updated timeline, substitute, cancellation, or refund where appropriate.
17. Changes to these Terms (and annual review)
We may update these Terms from time to time. The updated version will be posted in the applicable sales channel(s) with a revised effective date.
Unless applicable law requires otherwise, changes apply to future orders and channel use. The version in effect when we accept your order will apply to that order.
We intend to review these Terms at least annually.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
19. Entire agreement
These Terms, together with the applicable Product listing, order confirmation, invoice, and any written agreement specific to a custom order, form the entire agreement between you and Shack In The Back Designs regarding the applicable purchase.
If there is a conflict between these Terms and a written custom-order agreement signed or expressly confirmed by us, the custom-order agreement will govern that conflict.
20. No waiver
If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later. A waiver is effective only if provided in writing by an authorized representative of Shack In The Back Designs.
21. Governing law and jurisdiction
These Terms and any dispute arising from or relating to an order or our website are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory consumer protection rights, the courts located in Ontario, Canada will have jurisdiction over disputes arising from or relating to these Terms or an order.
